Neste artigo, Jean-Marie Beyssade oferece algumas indicações preciosas sobre como a reflexão de Espinosa no campo teórico acerca da normatividade imanente à ideia verdadeira (“a verdade é norma de si mesma e do falso”) fornece elementos que permitem iluminar seu esforço para pensar também no campo prático uma concepção de normatividade imanente, concepção esta que seria compatível com sua crítica radical (...) à finalidade externa e sua recusa de qualquer modelo exterior que condena o ser em nome do dever ser. En este artículo se presenta un análisis filosófico jurídico-penal de la extrema necesidad, a propósito del caso de las siamesas Jodie y Mary. Así, en la primera sección realizaremos una descripción sobre el contenido del estado de necesidad en situaciones de peligro de muerte. En segundo lugar, con la finalidad de ilustrar acerca de las discusiones axiológicas que existen en relación con los criterios de proporcionalidad entre el mal que se pretende evitar y el causado, ofreceremos una solución que nos (...) parece adecuada. En la tercera sección observaremos los presupuestos del caso de las siamesas y alguna de las líneas de argumentación que existen para justificar o exculpar su separación, sosteniendo que existen buenas razones para acoger el doble efecto en estos supuestos. This book examines contemporary structural social injustices from a feminist perspective. It asks: what makes oppression, discrimination, and domination wrongful? Is there a single wrongness-making feature of various social injustices that are due to social kind membership? Why is sexist oppression of women wrongful? What does the wrongfulness of patriarchal damage done to women consist in? In thinking about what normatively grounds social injustice, the book puts forward two related views. First, it argues for a paradigm shift in focus away (...) from feminist philosophy that is organized around the gender concept woman, and towards feminist philosophy that is humanist. This is against the following theoretical backdrop: Politically effective feminism requires ways to elucidate how and why patriarchy damages women, and to articulate and defend feminism's critical claims. In order to meet these normative demands an influential theoretical outlook has emerged: for emancipatory purposes feminist philosophers should articulate a thick conception of the gender concept woman around which feminist philosophical work is organized. However, Part I of the book argues that we should resist this move, and that feminist philosophers should reframe their analyses of injustice in humanist terms. Second, the book spells out a humanist alternative to the more prevalent gender-focus in feminist philosophy. This hinges on a notion of dehumanization, which Part II of the book develops. The argued for understanding of dehumanization is used to explicate the wrongness-making feature of social injustices, both in general and of those due to patriarchy. Dehumanization is not another form of injustice-rather, it is that which makes forms of social injustice unjust. The book's second part then provides a regimentation of social injustice from a feminist perspective in order to spell out the specifics of the proposed humanist feminism, and to demonstrate how it improves some non-feminist analyses of injustice too. Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

Feminist philosophy has recently become recognised as a self-standing philosophical sub-discipline. Still, metaphysics has remained largely dismissive of feminist insights. Here I make the case for the value of feminist insights in metaphysics: taking them seriously makes a difference to our ontological theory choice and feminist philosophy can provide helpful methodological tools to regiment ontological theories. My examination goes as follows. Contemporary ontology is not done via conceptual analysis, but via quasi-scientific means. This takes different ontological positions to be competing (...) hypotheses about reality’s fundamental structure that are then assessed with a loose battery of criteria for theory choice. Such criteria make up the constitutive values of ontology. These values are distinguished from contextual values of a practice: the political and moral values embedded in the social context of inquiry.. (shrink)

This paper develops an alternative for (what feminists call) ‘the sex/gender distinction’. I do so in order to avoid certain problematic implications that the distinction underpins. First, the sex/gender distinction paradigmatically holds that some social conditions determine one’s gender (whether one is a woman or a man), and that some biological conditions determine one’s sex (whether one is female or male). Further, sex and gender come apart. Since gender is socially constructed, this implies that women exist mind-dependently, or due to (...) productive human social activities; thus, it should be possible to do away with them just by altering the social conditions on which gender depends. In addition, some feminists take gender to depend on oppressive social conditions. Changing our social environments, then, would not only unwittingly eradicate women; doing away with women should be feminism’s political goal. I argue that both implications are unacceptable. In response, I argue for a view that has ontological commitments which are more congenial to ordinary thinking, and that doesn’t have the goal of eradicating women. (shrink)

The present study had two major aims: first, to examine the construct validity of the Finnish 58-item Corporate Ethical Virtues scale (CEV; Kaptein in J Org Behav 29:923–947, 2008) and second, to examine whether the associations between managers’ perceptions of ethical organisational culture and their occupational well-being (emotional exhaustion and work engagement) are indirectly linked by ethical strain, i.e. the tension which arises from the difference in the ethical values of the individual and the organisation he or she works for. (...) The sample consisted of 902 managers from different organisations, in middle and upper management levels, aged 25–68 years. The results of the confirmatory factor analysis (CFA) provided support to the hypothesised eight-factor structure of the CEV scale; i.e. the scale contained the factors of clarity, congruency of supervisors, congruency of senior management, feasibility, supportability, transparency, discussability and sanctionability. In addition, it emerged from the CFAs that the high intercorrelations of these factors can be explained by the second-order factor of ethical culture. The managers’ perceptions of the ethical culture prevailing in their organisations were associated with their occupational well-being both directly (high-work engagement) and indirectly via a low level of ethical strain (low-emotional exhaustion). Thus, the findings indicated that the ethical culture of organisations plays a major role in managers’ occupational well-being. (shrink)

This collection of eleven new essays contains the latest developments in analytic feminist philosophy on the topic of pornography. While honoring early feminist work on the subject, it aims to go beyond speech act analyses of pornography and to reshape the philosophical discourse that surrounds pornography. A rich feminist literature on pornography has emerged since the 1980s, with Rae Langton's speech act theoretic analysis dominating specifically Anglo-American feminist philosophy on pornography. Despite the predominance of this literature, there remain considerable disagreements (...) and precious little agreement on many key issues: What is pornography? Does pornography constitute women's subordination and silencing? Does it objectify women in harmful ways? Is pornography authoritative enough to enact women's subordination? Is speech act theory the best way to approach pornography? Given the deep divergences over these questions, the first goal of this collection is to take stock of extant debates in order to clarify key feminist conceptual and political commitments regarding pornography. This volume further aims to go beyond the prevalent speech-acts approach to pornography, and to highlight novel issues in feminist pornography-debates, including the aesthetics of pornography, trans* identities and racialization in pornography, and putatively feminist pornography. So far, the field of business ethics lacks validated measures for assessing virtues at the organizational level. The aim of this study is to investigate the measurement invariance of a shortened Corporate Ethical Virtues scale. In this manner, we contribute to validating an instrument that is both psychometrically sound and efficient to use. We conducted two survey studies of two independent groups (managers and school psychologists). Confirmatory factor analysis supported the eight‐factor model of the scale, and we found it to (...) be invariant in two different occupational groups. The managers gave higher appraisals of ethical culture than the psychologists did in seven out of the eight dimensions. We found that despite the contextual differences, the shortened scale measures the eight dimensions of organizational ethical virtues, as intended. Thus, the use of this more compact scale can be recommended for future studies, which will hopefully stimulate more research on ethical culture in various work contexts. (shrink)

Given the common assumption that measurement plays an important role in the foundation of science, the paper analyzes the possibility that Measurement Science, and therefore measurement itself, can be properly founded. The realist and the representational positions are analyzed at this regards: the conclusion, that such positions unavoidably lead to paradoxical situations, opens the discussion for a new epistemology of measurement, whose characteristics and interpretation are sketched here but are still largely matter of investigation.

Philosophers involved in the ‘porn-or-art’ debates standardly assume that pornography is centrally about sexual arousal, while art is about something else. I argue against this assumption and for the view that there is no single thing that pornography (or art) ‘is about’. This suggests that there is no prima facie reason for claiming that some x cannot be both pornography and art. I further go on to develop an understanding of (what I call) ‘porno-art’ - a wholly new kind of (...) thing developing from the extant categories of pornography and art, but still distinct and separate from them. This book provides an up-to-date introduction to the study of generics and pursues the enterprise of the influential Generic Book edited by Gregory Carlson and Jeffry Pelletier, which was published in 1995. Genericity is a key notion in the study of human cognition as it reveals our capacity to organize our perceived reality into classes and to describe regularities. The generic can be expressed at the level of a word or phrase (ie the potato in The Irish economy became dependent (...) upon the potato) or an entire sentence (eg in John smokes a cigar after dinner, the generic aspect is a property of the expression, rather than any single word or phrase within it). This book gathers new work from senior and young researchers to reconsider the notion of genericity, examining the distinct contributions made by the determiner phrase (eg the notions of kind/individual) and the verbal predicate (eg the notions of permanency, disposition, ability, habituality, and plurality). Finally, in connection with the whole sentence, the analytic/synthetic distinction is discussed as well as the notion of normality. Childfree females encounter greater obstacles in obtaining voluntary sterilizations than childfree males. This paper discusses what might explain this and it proposes that female patients encounter particular credibility deficits that undermine their ability to grant informed consent. In particular, the paper explores Miranda Fricker’s recent suggestion that members of structurally disadvantaged groups encounter a particular sort of injustice that harms them in their capacity as knowers: they sustain testimonial injustice. This paper considers Tirrell’s analysis of toxic speech using examples epitomising speech that are misleading, outright false, and without compelling justification. They are toxic in polluting and eroding democratic functioning. However, I argue that Tirrell’s two epidemiological models (the common source model exemplified by poisons, and the propagated transmission model that viruses exemplify) fail to make good sense of my examples, which are deeply insidious without being overtly invidious. The limitations of the epidemiological models suggest that toxicity is part of (...) our default form of thinking and talking, rather than being an ‘outside’ pathology like a poison or a virus. Background: Nurses’ collegiality is topical because patient care is complicated, requiring shared knowledge and working methods. Nurses’ collaboration has been supported by a number of different working models, but there has been less focus on ethics. Aim: This study aimed to develop nurses’ collegiality guidelines using the Delphi method. Method: Two online panels of Finnish experts, with 35 and 40 members, used the four-step Delphi method in December 2013 and January 2014. They reformulated the items of nurses’ collegiality identified by (...) the literature and rated based on validity and importance. Content analysis and descriptive statistical methods were used to analyze the data, and the nurses’ collegiality guidelines were formulated. Ethical considerations: Organizational approval was received, and an informed consent was obtained from all participants. Information about the voluntary nature of participation was provided. Results: During the first Delphi panel round, a number of items were reformulated and added, resulting in 32 reformulated items. As a result of the second round, 8 of the 32 items scored an agreement rate of more than 75%, with the most rated item being collegiality means that professionals respect each other. The item with second highest rating was collegiality has a common objective: what is best for patients, followed by the third highest which was professional ethics is the basis of collegiality. Conclusion: Nurses’ collegiality and its content are well recognized in clinical practice but seldom studied. Collegiality can be supported by guidelines, and nurses working in clinical practice, together with teachers and managers, have shared responsibilities to support and develop it. More research in different nursing environments is needed to improve understanding of the content and practice of nursing collegiality. (shrink)

Reciprocal sentences display a variety of interpretations, ranging from ‘strong reciprocity’ to ‘inclusive alternative orderings’. In this interpretation, every element in the reference set participates with some other member in the relation provided by the predicate either as the first or second argument. Current reciprocal theories cannot fully explain why some sentences that satisfy these truth conditions are in fact false and unacceptable, such as ‘#the boys are taller than each other’ or ‘#my mother and I procreated each other.’ The (...) core insight of the paper is that reciprocal sentences are true if they describe a relation that is either actually or possibly strong reciprocal over the reference set, insofar as the possibilities are reasonable. A branching time framework is used, in which a notion of reasonability is defined. We focus on permanent relations, for which we provide a new definition in modal terms. We show that whenever the relation is asymmetric and permanent, each other-sentences are unacceptable. We consider cases in which the relation is asymmetric and non-permanent and the each other-sentences are also unacceptable. We introduce a new modal notion of decidedness, and prove that for asymmetric relations, permanency entails decidedness. Showing how (a)symmetry, (non-)decidedness and (non-)permanency interact and proving that the truth of each other-sentences requires the relation to be either non-asymmetric or non-decided, we ensure a large and previously unattained empirical coverage. In 1837 the German-born astronomer F. G. W. Struve published his famous catalogue of double stars. For Struve this was the culmination of 12 years' detailed observation of a class of celestial objects lying exclusively beyond the solar system; for historians of astronomy it poses the problem of explaining why the study of double stars became a significant part of astronomical endeavour, as it did, during the 1820s and 1830s. For, although Struve's interest was extreme, it was shared to a (...) lesser extent by several eminent contemporaries, including John Herschel, Friedrich Bessel, Johann Encke, James South and Félix Savary. Their combined efforts represented an important transition in astronomy: for the first time one of the emphases of the subject moved beyond the solar system to the so-called fixed stars. The question of the emergence of interest in double stars is of historical significance, therefore, as it is related to the problem of the origins of ‘stellar astronomy’. This essay is thus intended to offer an explanation of astronomers' interest in double stars, and to tackle the related question of whether this transition constituted a major break in the history of astronomy. Furthermore it is proposed that answers to these problems may be found by considering the practice of astronomy dominant during the first half of the nineteenth century. Astronomers in this period were overwhelmingly concerned with a refined form of positional astronomy. The problems they chose to solve were by and large related to the difficulties of the accurate reduction of observational data, and the compilation of reliable tables and star charts, which were then used as a background against which the motions of solar system objects were plotted. By assessing individuals' studies of double stars within this context it can be seen firstly that such studies were no more or less than specific examples of a general case, and secondly that the stars themselves were not usually of intrinsic interest. Collegiality is one of the fundamental values of the nursing profession. During the nursing history, collegiality has been described as part of a nurse’s relationship with their peers and it influences the quality of care they provide and job satisfaction and commitment to their work. Despite earlier definitions, the concept of collegiality in nursing has remained unclear. The aim of this study was to clarify the concept of collegiality in the nursing profession, using Rodger’s evolutionary concept analysis. We carried out (...) electronic searches using the CINAHL, PubMed, Scopus, Web of Science, SocINDEX, PsycINFO and Eric databases and manual searches of the reference lists of the selected papers. The searches were limited to peer-reviewed papers published in English language from the inception of database to November 2022. This identified 25 papers. Based on our analysis, the attributes of the concept of collegiality were achieving mutual goals together with equality, reciprocity, trusted advocacy, powerful self-regulation and engaged belongingness. Antecedents of the concept included existing professional group, connection between professionals and professional self-esteem. The consequences were strengthening nurses’ professional status, job satisfaction and their ability to provide the best possible patient care. We found that nurses’ collegiality was a value-based concept, with a unique character based on professional connections. The concept brought together ethical and pragmatic strategies to achieve the best possible results for the nursing profession. Provided knowledge can be applied for further development of the concept and applying it in clinical research and practice. The concept of nurses’ collegiality should also be studied in the future because both the profession and their working environment are constantly changing. (shrink)

This article clarifies how the freedom of thought as a human right can be understood and promoted as a right of mental health service users, especially people with psychotic disorder, by using Martha Nussbaum’s capabilities approach and Fulford’s and Fulford et al ’s values-based practice. According to Nussbaum, freedom of thought seems to primarily protect the capability to think, believe and feel. This capability can be promoted in the context of mental health services by values-based practice. The article points out (...) that both Nussbaum’s approach and values-based practice recognise that people’s values differ. The idea of involving different actors and service users in mental healthcare is also common in both Nussbaum’s approach and values-based practice. However, there are also differences in that values-based practice relies on a ‘good process’ in decision-making, whereas the capabilities approach is oriented towards a ‘right outcome’. However, since process and outcome are linked with each other, these two approaches do not necessarily conflict despite this difference. The article suggests that absolute rights are possible within the two approaches. It also recognises that the capabilities approach, values-based practice and human rights approach lean on liberal values and thus can be combined at least in liberal societies. (shrink)

Martha Nussbaum endorses a kind of humanist feminism, which (for her) involves articulating the notion of human being as a normative ethical concept: once this normative concept is articulated, it can be employed to pick out those modes of treating women that are inappropriate with the view to developing corrective public policies. Contra Nussbaum, Louise Antony argues that human being cannot be defined in a normative sense. For Antony, the only plausible human universals are biological or genetic traits, which lack (...) the required ethical component. This, in Antony’s view, undermines humanist feminism because the prospects of cashing out an ethically normative concept of human being are not good. However, I argue this doesn’t undercut humanist feminism. Instead, feminists can single out inappropriate modes of treating women by developing a politically useful notion of dehumanization. My strategy takes rape to be a paradigm case of dehumanizing treatment and examines what key features make it dehumanizing. These key features, then, can be used to develop a general account of dehumanization. (shrink)

We show that actuality entailments arise with goal-oriented modality only and endorse Belnap’s view of that goal-oriented modals use historical accessibility with a fixed past and an open future. This modal-theoretic assumption allows us to spell out the precise modal-temporal configuration in which the actuality entailment arises and our predictions are borne out by the data, cross-linguistically. We also show that, when any assumption about the identity of worlds at branching point is leveled - which appears to be the case (...) with generic deontic and opportunity modals, the actuality entailments disappear. We also predict that the entailment disappears with prospectivity. Finally, we argue that modal sentences giving rise to actuality entailments are informative, insofar as the contribution of the modality survives as a presupposition that the modal base is non-homogeneous. Italian is a well-known exception to the cross-linguistic generalization according to which `belief' predicates are indicative selectors across languages. We newly propose that languages that select the subjunctive with epistemic predicates allow us to see a systematic polysemy between what we call an expressive-`belief' (featuring only a doxastic dimension) and an inquisitive-`belief' (featuring both a doxastic and an epistemic dimension conveying doxastic certainty (in the assertion) and epistemic uncertainty (in the presupposition)). We offer several previously unseen contrasts proving this distinction (...) and offer a new analysis for mood choice cross-linguistically. We argue that the distinction between expressive and inquisitive attitudes is not an idiosyncrasy of non-factive epistemics. We provide novel data, showing that fictional predicates (dream, imagine) license the subjunctive. We explain the indicative/subjunctive alternation by again appealing to epistemic uncertainty and disentangling expressive from inquisitive-fictional meanings. We thus pave the way for a new typology of attitudes relying on this systematic polysemy and propose new criteria to explain mood distribution cross-linguistically. (shrink)

Es innegable la importancia que tiene el catálogo como instrumento de registro histórico-artístico en el marco discursivo de toda exposición. Por ello, se ha incidido tanto en su valor como fuente de información y herramienta fundamental de investigación académica sobre el artefacto artístico. Su formato impreso ha trascendido las barreras del tiempo, adaptándose en cada momento a las necesidades comunicativas derivadas de cada contexto particular. La explosión pandémica de la COVID-19 marca un punto de inflexión en este aparataje valorativo, difusor (...) y creador de conocimiento, permitiendo a los profesionales-humanistas la reflexión sobre el uso de otros formatos de registro y/o difusión complementarios; entre estos, los ligados a las tecnologías computacionales y realidades mixtas, posibilitando la adaptación de los contenidos museográficos y los hilos argumentales de lo exhibido a las situaciones derivadas de la alerta sanitaria. Partiendo de tales premisas, el objetivo del presente estudio es demostrar cómo lo virtual hace posible la concienciación valorativa −formal y estética− de la totalidad intangible del universo lumínico contemporáneo que se exhibe en museos, galerías y espacios expositivos. Para ello, se analizan las limitaciones del catálogo tradicional −editado o digitalizado− con la intención de proponer una alternativa de registro integral; un proceso experiencial que, a su vez, generará una línea de trabajo en la que los resultados derivados de una concienzuda investigación terminan validando la hipótesis inicial. The purpose of this study, which is part of a wider study of professional ethics, was to describe nurses’ perceptions of their rights in Italy. The data were collected by open-ended focus group interviews and analyzed with inductive content analysis. Based on the analysis, three main themes were identified. The first theme “Unfamiliarity with rights” described nurses’ perception that their rights mirrored historical roots, educational content, and nurses’ and patients’ position in the society. The second theme, “Rights reflected in legislation” (...) highlighted that working and professional Italian legislation played a strong role. The third theme, “Managerial barriers for nurses’ rights” underlined the nurses’ perceptions that nursing management had the responsibility to create the conditions where nurses’ rights could flourish. Background: The interest in the children’s role in pediatric care is connected to children’s health-related autonomy and informed consent in care. Despite the strong history of children’s rights, nurses’ role in the everyday nursing phenomenon, that is, restraint in somatic pediatric care, is still relatively seldom reported. Aim: The aim of this study is to describe nurses’ perceptions of the use of restraint in somatic pediatric care. The ultimate aim is to deepen the understanding of the phenomenon of restraint, whose (...) previous study has been fragmented. Methods: Qualitative approach was selected because of the lack of previous information. Due to the sensitivity of the research question, individual interviewees were selected among voluntary nurses (n = 8). All participants were registered nurses with general work experience as nurses of 5–16 years on average and specifically 1.5–10 years in pediatric nursing. Inductive content analysis was used for aiming to produce a synthesis of the research phenomenon. Ethical considerations: The research received organizational approval by the university hospital, and informed consent and confidentiality were ensured. Results: Restraint in pediatric nursing was process-like, but occurred without advanced planning. The restraint-related process included five categories: (a) identification of the situations where restraint may occur, (b) finding preventive methods, (c) identification of different forms of restraint, (d) rationing the use of restraint, and (e) post-restraint acts. Restraint was seen as a part of pediatric nursing which occurred daily and involved several professionals. According to the nurses’ illustrations, restraint means doing things even when a child is not agreeable. Conclusion: Restraint is part of somatic pediatric nursing, described as the last, but in some cases, the only resort for carrying out care or treatment. Restraint is not a goal in itself, but an instrumental tool and procedure in carrying out care. In the future, more information about nurses’ role and the use of restraint in pediatric nursing is still needed. (shrink)

The subject of “The Other”, the different one always generated conflicts more or less serious in the history of humanity, without proposals of any resolution. In the measure in that The Other questions, by similitude or by difference, the identity in which the subject is sustained, that questioning make unstable that precarious construction, and because of this, it converts itself in the opposer. In this study, we will find, in the text of Il Visconte Dimezzato by Italo Calvino, the subject (...) of the Otherness/Alterity, analyzing from the semiotic point of view the reactions and behaviors of each one of the two characters and of the members of the society in which they live. The starting point of the story by Italo Calvino is that in a war between Austria and the Turks, the Viscount Medardo di Terralba as a consequence of a canon shot remains divided vertically into two halves and both halves survive. One of the two halves is very bad and the other is very good. Each one of the two halves sees in the other one “The Other”, feeling itself “The One” but incomplete and desiring to turn to be “The Same” as it was before being divided by the canon shot. (shrink)

Se abordará la relación de incompatibilidad entre la idea del Estado legitimado para el uso de la violencia y la figura del justiciero. Cómo desde el mundo del cómic ha sido representado no como un defensor de la justicia sino como alguien que actúa al margen de la ley.

Este ensayo explora algunas representaciones de la figura de Federico García Lorca en la televisión y el cine españoles de las últimas décadas. El énfasis en la representación de la figura de García Lorca más que en las adaptaciones de sus obras dramáticas favorece el análisis de dos cuestiones íntimamente conectadas entre sí: en primer lugar, la representación mediático-audiovisual del proceso de creación literaria y de la interacción de autor y texto –es decir, cómo se construye la figura del escritor (...) como ente creador, cómo se entiende dicho proceso de creación, y muy especialmente cómo se presenta la relación e influencia mutuas entre la vida y la obra del artista– y en segundo lugar, la construcción, realizada desde la distancia temporal y desde un contexto muy diverso al de su propia vida, de la figura del artista como personaje histórico y mito cultural. Este enfoque parece especialmente apropiado al tratarse de un autor que, por su vida y su muerte tanto o más que por su obra, ha pasado de ser un proscrito bajo el primer franquismo a convertirse en una figura emblemática de la Andalucía autonómica y de la España democrática. ABSTRACT In contemporary U.S. public discourse, calls for achieving equity abound. Many metrics now measure equity being achieved. I inquire into whether equity can be said to be achieved and still be equity. Inquiring as such leads me to excavating the menacing and actual cultural violence of developing such achievement. Simultaneously, this excavation shows the rhetoric of equity qua equity as a means of abolishing the conditions for that violence to take hold. I put forward that equity cannot be said (...) to be achieved without the conditions of possibility equity offers being colonized. If a commitment to antiviolence speaks, it cannot say, “Equity achieved.”. (shrink)

La vida entera de muchos ensayistas transcurre sin dar jamás con un tema. Este ensayo no sólo se topa con un tema, sino que incluso se da el lujo de aprovecharlo. El tema es la felicidad. Sin embargo, La herida de Spinoza es un libro de ?losofía, no de autoayuda. Parte de algunas conclusiones recientes de la neurología, en particular de las investigaciones de Antonio Damasio acerca de la impertinencia de la secular división entre mente y cuerpo. El propio Damasio (...) vincula sus investigaciones con las ideas que Spinoza expuso en su Ética. Para Damasio, la tranquila aceptación de la muerte, una de las señas de identidad de la ética de Spinoza –de hecho, la «herida» de Spinoza–, resulta «irritante». Ese comentario de Damasio parece inocuo, pero para Vicente Serrano no lo es, sino que apunta a una especie de «desajuste», a una extraña incomprensión de la diferencia última de la ética spinozista. A partir de ahí el autor no se propone criticar solamente esa y otras lecturas de Spinoza, sino que plantea además una amplia crítica a la modernidad, y también a la posmodernidad. La herida de Spinoza se convierte entonces en una revisión de la historia entera de la ?losofía en esa zona en que ética y metafísica (u ontología) se superponen. Aunque el proyecto parece apabullante, el autor se asegura de estar bien equipado. Por una parte suprime el aparato académico, lo que le permite ser más breve y directo, y por otra echa mano de una erudición notable y, sobre todo, de una capacidad absolutamente inusual de explicación. Si hubiera que buscar parangones a esa capacidad, no quedaría más remedio que acudir a Rüdiger Safranski. El autor, sin embargo, no hace biografías, ni siquiera historia de la ?losofía como tal, sino que intenta ?losofar de la mano de los más grandes pensadores de la historia. El ensayo se completa con la inclusión de una pieza maestra: los afectos. Los afectos serían la respuesta posible de la ?losofía al problema de la biopolítica. La progresión de la modernidad no sólo implica la desaparición de la naturaleza, sino la sustitución absoluta de los afectos por la voluntad (de voluntad). Si la vuelta a la naturaleza es imposible, e incluso indeseable –dado que la naturaleza no fue nunca más que una metáfora–, Serrano se inspira en Foucault para proponer una «vuelta» a los afectos como la pieza fundamental que cierra la reflexión sobre el poder. «Un ensayo en el sentido más ágil del término, obra a mitad de camino entre lo reflexivo y lo literario… Bien pensado y bien escrito, muchísimo más de lo que se ha vuelto habitual en nosotros» (Gabriel Albiac, Leer). «La cuestión de fondo teórica –a qué responde la religión y qué problemas de comprensión existencial atiende o atendía– es algo mucho más complejo y creo que más apasionante. Un buen tratamiento filosófico de la cuestión es el que ofrece Vicente Serrano en La herida de Spinoza, reciente ganador del Premio Anagrama de Ensayo… Serrano explora las consecuencias posmodernas del abandono de las religiones: un tema más sugestivo que la refutación de las iglesias...» (Fernando Savater, El País). «Iniciado como un arroyo para abrirse en un delta que abarca toda la modernidad filosófica, la obra de Serrano analiza, sin pedantería ni falsas oscuridades, las inflexiones que han tenido los conceptos de religión, deseo, naturaleza, esperanza, progreso, poder y felicidad» (Juan Malpartida, ABC). «Entre quienes lo lean sumará cientos de fascinados. Fiel a ella, y elevándola a condición de eje hermenéutico, Vicente Serrano reconstruye los hitos fundamentales del proceso, atendiendo especialmente al propio Jacobi, pero también a los “grandes” del Idealismo Alemán, así como a Nietzsche, a Heidegger, a Michel Foucault, a las diversas teorizaciones “posmodernas” —o no— de los últimos tiempos. Es posible, en efecto, que haya más (...) teología en la filosofía contemporánea, allí donde su presencia lo es bajo la forma de una abrasadora ausencia, que allí donde se ofrece a rostro abierto… ese es, en cualquier caso, el desafío hermenéutico de este trabajo memorable. This article questions the commonly accepted belief that God, like a ceramic potter, is able to control the outcome of events even as the potter controls the outcome of the clay-throwing process. However, those who are familiar with the artistic process of creating with clay know well that this is a symbiotic dynamic between the creator and the clay, as is that between God and human events.

In “The Brokenness of Being,” Mari Ruti investigates the impact that trauma can have on being. Informed by her own experience of breast cancer, Ruti argues that there are some traumatic experiences that entirely change one’s symbolic coordinates. She calls these types of experiences benchmark traumas. Diagnosed with terminal cancer, Ruti boldly explores how encountering a benchmark trauma forced her to recognize the brokenness of her being. She theorizes that this recognition reveals the split in the subject. Encountering this brokenness, (...) as she calls it, at the heart of being can be completely debilitating. However, Ruti argues, there is a way to engage rather than repress this impossible reality. She theorizes that creativity is the one human expression that can grapple authentically with the split in the subject. To explore this idea, she collaborates with painter Dwight Smith. Smith’s twenty-two paintings respond to the benchmark trauma of the death of his twenty-two-year-old daughter. The twenty-two paintings are positioned throughout the manuscript and are in conversation with Ruti’s theory. Ruti is fascinated by both the paintings and Smith’s process, which is similar to her own. For Ruti and Smith, their creativity is how existential engagement takes shape. (shrink)

In this article, accounts of the destructiveness of mechanical resonance signal a telling lacuna in humanities scholarship, one this article works to remove.

The volume addresses a variety of issues on Stance and Inter/Subjectivity, and the expression of Identity in discourse. It focuses on the multifaceted nature of stance, and the use of resources of epistemicity, effectivity, and evaluation and metaphor, as well as other dimensions within the domain of stance, such as mirativity, emotion and attribution. En la actualidad asistimos a un renacer del pensamiento comunicacional latinoamericano en el seno de las ciencias de la comunicación, que propone una mirada reflexiva y alternativa a las lógicas comunicativas del capitalismo global. El texto de Reyes Mate, Pensar en español aquí y ahora, se utiliza en este artículo como piedra angular del análisis de este renacer, por su capacidad para estimular el estudio de las aportaciones específicas de la Comunicación para el Cambio Social en español al conjunto del (...) campo de la comunicación y, quizá, también a otros campos del conocimiento. Así, las ideas que lo estructuran son: 1) el pensamiento comunicación en español es, en la actualidad, un pensamiento dependiente; 2) la comunicación no puede ser inmoral y 3) Pensar la comunicación desde el sur para un pensamiento comunicacional crítico de ida y vuelta. A década de 90 e o início do século XXI estão marcados por reformas que atingem as estruturas do Estado brasileiro e com ela também a Educação Superior. Reformas que recambiam a noção de direito público à educação, ao conhecimento, à função do Estado, aos financiamentos, regidas pela agência Banco Mundial (BM). Nesse movimento, a terminologia sociedade do conhecimento emerge como fundamento epistemológico condicionando à universidade o papel de produtora de conhecimentos de valor econômico e de consenso. Mobiliza-se, assim, um (...) conjunto de orientações e discursos de agentes nacionais e internacionais para dar legitimidade às reformas tornando a Educação Superior objeto crescente de disputa de mercados e de espaços de resolução de problemas da pobreza e do desenvolvimento. Analisamos documentos nacionais e internacionais e literaturas especializadas para compor nosso debate. Partimos de dados documentais buscando compreender o conjunto das orientações às políticas para o Ensino Superior e as implicações em termos de reformas no País. Defendemos a hipótese de que os conhecimentos são orientados para produzir consenso social por meio de discursos de equidade e desenvolvimento, discursos que encobrem a verdadeira natureza das reformas que se caracterizam pelo monopólio do conhecimento e perpetuação da exclusão social. A shipping war has broken out between two friendly neighbouring countries: Estonia (a rather poor land; liberated of Soviet occupation in 1991), and Finland (a wealthy one; independent since 1918). Led by their trade union the Finnish dockers boycott Estonian ships demanding for Estonian sailors the salary in the same range as that is in wealthy West-European countries. Estonian Sailors'' Union finds that such a war is not for their better work-conditions but against their working possibilities: the cheap labour force (...) is the only possibility for a poor country to entice foreign investments in it.No matter how the shipping war will be solved – the problem will remain. This is the problem of two opposites – cheap labour force of poor countries and expensive one of wealthy countries –, and international enterprises standing between them. Could such an enterprise survive without using the cheap labour force? And if it could, how could the poor countries survive then? Could there be found a clear unambiguous ethical solution? What ought to be the role of trade unions in such international business conflicts? (shrink)

Autonomy has been recognised as a key principle in healthcare, but we still need to develop a consistent understanding of older people’s perceived autonomy in residential care. This study aimed to identify, describe and synthesise previous studies on the perceived autonomy of older people in residential care. Ethical approval was not required, as this was a review of published literature. We carried out an integrative review to synthesise previous knowledge published in peer-review journals in English up to September 2019. Electronic (...) and manual searches were conducted using the CINAHL, Philosopher’s Index, PubMed, SocINDEX, Scopus and Web of Science databases. The data were analysed using the constant comparison method. The review identified 46 studies. Perceived autonomy referred to the opportunities that older people had to make their own choices about their daily life in residential care, and achieving autonomy promoted both health and quality of life. Autonomy was linked to older people’s individual capacities, including their level of independence, physical and mental competence, personal characteristics, and whether relatives shared and supported their perceived autonomy. Professionals could facilitate or hinder older peoples’ autonomy in a number of ways, including providing opportunities for autonomy, how daily care needs and activities were managed, and controlling older people’s choices. Professionals’ characteristics, such as education and attitudes, and the older people’s living environments were also associated with their perceived autonomy and included organisational characteristics and physical and social care facilitators. Older people’s perceived autonomy promoted health and quality of life in residential care. However, their autonomy was associated with a number of protective and restrictive individual and environmental factors, which influenced whether autonomy was achieved. (shrink)

In the last few decades the role played by models and modeling activities has become a central topic in the scientific enterprise. In particular, it has been highlighted both that the development of models constitutes a crucial step for understanding the world and that the developed models operate as mediators between theories and the world. Such perspective is exploited here to cope with the issue as to whether error-based and uncertainty-based modeling of measurement are incompatible, and thus alternative with one (...) another, as sometimes claimed nowadays. The crucial problem is whether assuming this standpoint implies definitely renouncing to maintain a role for truth and the related concepts, particularly accuracy, in measurement. It is argued here that the well known objections against true values in measurement, which would lead to refuse the concept of accuracy as non-operational, or to maintain it as only qualitative, derive from a not clear distinction between three distinct processes: the metrological characterization of measuring systems, their calibration, and finally measurement. Under the hypotheses that (1) the concept of true value is related to the model of a measurement process, (2) the concept of uncertainty is related to the connection between such model and the world, and (3) accuracy is a property of measuring systems (and not of measurement results) and uncertainty is a property of measurement results (and not of measuring systems), not only the compatibility but actually the conjoint need of error-based and uncertainty-based modeling emerges. Background Healthcare leader support and facilitation for ethics work are of great importance for healthcare professionals’ handling of ethical issues, moral distress, and quality care provision. A digital tool for ethical reflection in long-term care was developed in response to the demand for appropriate tools. Research aim This study aimed to explore healthcare leaders’ expectations of using a digital tool for ethical reflection among their home nursing care staff. Research design A qualitative research design with vignettes and focus group interviews (...) was used. The data were analyzed using reflexive thematic analysis. Participants and Research Context The sample comprised ten healthcare leaders from municipal long-term care in Norway. Ethical Considerations Participation was voluntary and based on informed consent. The Norwegian Agency for Shared Services in Education and Research approved this study. Findings The analysis resulted in the development of three themes representing leaders’ expectations of the tool: (i) giving staff a voice, (ii) revealing ethics in practice, and (iii) keeping the pot boiling. Discussion Leaders must be informed about the ethical issues experienced to engage in supportive measures for their staff. Digital channels can increase the democratization, safety, and efficiency of communication between employees and leaders and increase awareness of ethical aspects in daily care work. The leaders had positive expectations of employees’ activities and benefits from using the tool for ethical reflection. However, they admitted that realizing the tool’s potential to ensure continuity in ethics work requires considerable organizational and leader involvement. Conclusions This study shows that healthcare leaders are open to digital solutions for managing ethics work in home nursing care. Both opportunities and important prerequisites for successfully implementing the digital tool were identified. (shrink)

Employment is critical for refugees’ positive integration into a receiving country. Enabling employment requires cross-sector collaborations, that is, employers collaborating with different stakeholders such as refugees, local employees, other employers, unofficial/official supporters, and authorities. A vital element of cross-sector collaborations is trust, yet the complexity of cross-sector collaborations may challenge the formation and maintenance of trust. Following a theory elaboration approach, this qualitative study with 37 employers and 27 support workers in Germany explores how employers’ experiences in cross-sector collaborations on (...) refugees’ labor market integration affect their trust in other stakeholders in this cross-sector space. Specifically, we explored employers’ perceptions of trust breaches, and how these perceptions affect their further engagement in cross-sector collaborations on refugee integration. Based on our findings, we propose a process model that describes how unmet collaboration expectations and negative assessments of collaborators’ attitudes and behaviors lead to perceived trust breaches which, in turn, lead to employers’ hesitancy to hire refugees and/or to engage in cross-sector collaborations. In doing so, we extend existing theory on trust within organizations to the cross-sector context of refugee integration, uncovering context-specific meanings to trustworthiness dimensions and illustrating how breaches of different trustworthiness dimensions can interact. Moreover, we show how social policies, resources, and trustors’ perceived vulnerability in collaborations shape their risk perceptions. This study highlights the central role of trust for refugee integration and illustrates how missing goals and process clarity endanger sustainable collaborations. (shrink)

Computational explanations focus on information processing required in specific cognitive capacities, such as perception, reasoning or decision-making. These explanations specify the nature of the information processing task, what information needs to be represented, and why it should be operated on in a particular manner. In this article, the focus is on three questions concerning the nature of computational explanations: What type of explanations they are, in what sense computational explanations are explanatory and to what extent they involve a special, “independent” (...) or “autonomous” level of explanation. In this paper, we defend the view computational explanations are genuine explanations, which track non-causal/formal dependencies. Specifically, we argue that they do not provide mere sketches for explanation, in contrast to what for example Piccinini and Craver :283–311, 2011) suggest. This view of computational explanations implies some degree of “autonomy” for the computational level. However, as we will demonstrate that does not make this view “computationally chauvinistic” in a way that Piccinini or Kaplan :339–373, 2011) have charged it to be. (shrink)

Background: The concept of dignity can be divided into two main attributes: absolute dignity that calls for recognition of an inner worth of persons and social dignity that can be changeable and can be lost as a result of different social factors and moral behaviours. In this light, the nursing profession has a professional dignity that is to be continually constructed and re-constructed and involves both main attributes of dignity. Objectives: The purpose of this study was to determine how nurses (...) described nursing’s professional dignity in internal medicine and surgery departments in hospital settings. Research design: The research design was qualitative. Ethical considerations: This study was approved by the ethics committees of the healthcare organizations involved. All the participants were provided with information about the purpose and the nature of the study. Participants: A total of 124 nurses participated in this study. Method: The data were collected using 20 focus group sessions in different parts of Italy. The data were analysed by means of a conventional inductive content analysis starting from the information retrieved in order to extract meaning units and sorting the arising phenomena into conceptually meaningful categories and themes. Results: Nursing’s professional dignity was deeply embedded in the innermost part of individuals. Regarding the social part of dignity, a great importance was put on the values that compose nursing’s professional identity, the socio-historical background and the evolution of nursing in the area considered. The social part of dignity was also linked to collaboration with physicians and with healthcare assistants who were thought to have a central role in easing work strain. Equally important, though, was the relationship with peers and senior nurses. Conclusion: The organizational environments under scrutiny with their low staffing levels, overload of work and hierarchical interactions did not promote respect for the dignity of nurses. To understand these professional values, it is pivotal to comprehend the role of different health professions in their cultural milieu and the evolution of the nursing profession in diverse countries. Background: Nurses frequently face ethically demanding situations in their work, and these may lead to stress of conscience. Working life is currently accelerating and job demands are intensifying. These intensified job demands include (1) work intensification, (2) intensified job-related planning demands, (3) intensified career-related planning demands, and (4) intensified learning demands. At the same time, many healthcare organizations are implementing major organizational changes that have an influence on personnel. Aim: The aim of the study was to investigate the association between (...) intensified job demands and stress of conscience, and whether their association is moderated by organizational change experiences among nurses. Experiences of organizational change may expose employees to stress of conscience or serve as a buffer because employees appraise, involve, and cope with changes differently. Research design: Questionnaires measuring stress of conscience, intensified job demands, and organizational change experiences were completed by nurses (n = 511) in a healthcare district undergoing a major organizational change. Ethical considerations: Throughout, the study procedures were implemented according to the guidelines of the Finnish National Board on Research Integrity and the 1964 Helsinki Declaration and its later amendments. According to the Finnish regulations, because participation was voluntary, informed consent was requested, and participants were advised of their right to withdraw from the study at will. No permission from an ethics committee was necessary. Findings: Work intensification and personal worry considering organizational change were associated with more severe stress of conscience among nurses. Nurses’ experiences of managements’ competent handling of organizational change buffered the association between work intensification and stress of conscience. Conclusions: During organizational changes, management may alleviate nurses’ stress of conscience by proper communication and support procedures. (shrink)
